New Delhi: The undergraduate medical students can migrate from one college to another only if both the colleges are recognised by the Central Government, the Supreme Court said on Thursday, February 4.
The top court set aside the September 2020 Rajasthan High Court verdict that had directed the Medical Council of India (MCI) to permit the migration of MBBS student Anchal Parihar from an unrecognised medical college to a recognised one.
The apex court bench comprising justices L Nageswara Rao and Indira Banerjee stated that the interpretation of the Regulation 6(2) of the Migration Rules by the HC is patently erroneous, reported ABP Education.
According to the bench, the Regulation clearly lays down a restriction of migration from an unrecognised college to a recognised one. The migration is only possible when both colleges are recognised under section 11(2) of the Indian Medical Council Act of 1956, the report stated.
Meanwhile, student of Ananta Institute of Medical Sciences and Research Centre, Rajsamand, Parihar had sought permission to migrate to Dr SN Medical College, Jodhpur, in 2019, which the MCI had denied.
